THE Q “DONATE & WIN” CONTEST
RULES & REGULATIONS
1. THE CONTEST AND THE CONTEST PERIOD
The “Q DONATE & WIN” (the “Contest”) commences at 10:00 AM E.T on January 15, 2010 and concludes at 4:00 PM E.T. on January 21, 2010 (the “Contest Period”).
2. ELIGIBILITY
The Contest is open to residents of Quebec who are twenty-one (21) years of age and over, legally able to travel to the Bahamas or Jamaica but excluding employees, directors and officers of CFQR-FM (“The Q”), Corus Entertainment Inc. (“Corus”), any affiliate (as defined in the Canada Business Corporations Act) of The Q or Corus (the “Affiliates”), employees, directors and officers of Sandals Resorts or Dormez-Vous (the “Sponsors”), employees, directors and officers of their respective advertising and promotional agencies, as well as family members of any of the foregoing. For the purpose of these rules, “family” means spouses, children, parents, siblings, or persons with whom you are domiciled. Listeners who have won a prize from The Q with a value of at least $1,500 within a period of twenty four (24) months prior to the beginning of the Contest Period are not eligible.
3. HOW TO ENTER
Click on the UNICEF link on 92.5 The Q’s website at www.925theq.com. Make a donation to enter the Contest. A minimum $10 donation is required for each entry. Each $10 increment qualifies as one automatic entry. Unlimited entries permitted.(i)
(ii) On January 22, 2010 before 9:00 AM, one (1) Finalist will be randomly selected and awarded the Grand Prize.
4. THE PRIZE
(i) There is one (1) Grand Prize available to be won:
A seven-night prize trip for one couple to Sandals Royal Bahamian Spa Resort & Offshore Island in Nassau, Bahamas or ANY Sandals resort in Jamaica. Each trip includes return airline transportation to and from Nassau (or Montego Bay), return transfers from the airport to the resort; seven nights of luxurious accommodation; all meals including anytime snacks and unlimited beverages; nightly entertainment; all water and land sports; and all government hotel taxes and tips.
(ii) Terms and Conditions of Prize:
-Sandals Resorts reserves the right to relocate any processed prizewinner from their hotel of choice to an alternate resort within the chain or to alternate dates, based on availability of space.
-The prize trip is subject to travel between April 1, 2010 – November 1, 2010.
-A gift certificate outlining the terms of the prize and redemption procedure for the prize trip will be provided at the conclusion of the promotion and upon receipt of support collateral material (i.e. promo spots, website exposure, etc.)
(iii) Prize trips are based on space availability and confirmation of travel dates will only be provided 30 days prior to the departure date.
(iv) In order to be awarded a Prize, the Winner must designate one (1) travel companion, who must travel on Prize Flight with the Winner, at least five (5) business days after being notified that he/she is the Winner. No changes to travel dates or passenger names are permitted once a booking has been confirmed for the Prize. Winner and his/her guest must travel on the same itinerary for both the outbound and inbound portions of the Prize Flight. Winner and designated travel companion are responsible for all expenses other than those mentioned above as included, including but not limited to ground transportation to and from gateway airports, travel meals, telephone, fax or cable charges, merchandise, souvenirs, travel insurance, travel documentation, hotel incidentals and all other personal expenses of any kind. The Prize Suppliers are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any Prize and Winners will not be compensated in the event of such delay, cancellation or other event described herein. Prize must be taken as offered and is neither transferable nor redeemable for cash, credit or alternative prizes, except in the Prize Suppliers’ sole discretion. Prize cannot be sold and in the event that it is sold, the Prize will be void. The Prize Suppliers reserve the right to substitute the Prize with a prize of equal or greater value. No credit or reimbursement will be provided if Prize is not taken. Prize cannot be combined with any other promotional offer or offers provided by Prize Suppliers. Cancellations to the Prize are accepted up to 24 hours prior to departures. If cancelled, Prize will not be reinstated; Prize will be null and void. Prize Flight is governed by laws, regulations, international conventions, Sandal’s tariffs and conditions of carriage. Other restrictions may apply.
(v) Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
(vii)Winners will be required to execute a legal agreement and release (“Release”) that confirms Winners: (i) eligibility for the Contest and compliance with the Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of Prize Suppliers and their parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize including without limitation, costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from; and (iv) grant to Prize Suppliers the unrestricted right, in the its discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the Winners’ name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The Winners must also arrange for the signature and return of a Declaration and Release by each of their designated travel companions, who must also be a resident of Quebec, before being entitled to the prize. If the Winners’ guest is a minor, such person must have consent from their parent or legal guardian who must sign the Declaration and Release on their behalf and accompany them on the trip. The executed Release must be returned within two (2) business days of the verification as Winners or the selected Winners will be disqualified and the Prize forfeited. Winners must provide sponsor with full legal names of designated travel companions within three (3) business days after Release is signed and returned.
5. DEADLINE FOR CLAIMING GRAND PRIZE
Prize winners must claim their prize by attending at The Q offices located at 800 de la Gauchetiere West, Suite 1100, Montreal, Quebec, no later than February 28, 2010. If a Prize winner fails to claim their Prize before the deadlines, he or she will forfeit the Prize.
6. CONDITIONS
a. Guests must comply with all Contest Rules.
b. All prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash. Sponsors reserve the right, in their sole discretion, to substitute a prize of equal or greater value if the described prize cannot be awarded for any reason.
7. OTHER EXPENSES
The Grand Prize Winner is responsible for all incidental expenses incurred in connection with accepting the Grand Prize. The Grand Prize winner understands that he or she may not seek reimbursement for the Expenses from The Q, Corus, the Affiliates or their respective advertising and promotional agencies.
8. NO REPRESENTATIONS OR WARRANTIES
Neither The Q nor Corus makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Grand Prize. The Grand Prize winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from The Q or Corus should the Grand Prize fail to be fit for its purpose or is in any way unsatisfactory to the Grand Prize winner.
9. DECLARATION AND RELEASE OF GRAND PRIZE WINNER
Before being awarded a Prize, the Prize winner must:
(i) Present valid government issued identification;
(ii) Correctly answer, unaided, a time-limited skill-testing mathematical question; and
(iii) Sign a standard form confirming that by entering the Contest:
-he or she read, understood and accepted these rules and regulations;
-that he or she understands that acceptance of the Prize may involve danger and/or exposure to risks and hazards of both man-made and natural origin, whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he or she may suffer damage to personal property, serious personal injury, illness or even death;
-the Grand Prize winner acknowledges that Sandals (“Prize Supplier”) is responsible for providing the Grand Prize and that he or she releases The Q, Corus and the Affiliates and all of their directors, officers, employees, agents (the “Releasees”) from any liability arising in connection with the Grand Prize, with his or her participation in the Contest and acceptance of the Grand Prize including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting of any aspect of the Grand Prize, whether suffered by the Grand Prize winner, or by his or her heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees;
-that he or she nevertheless freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Contest and winning the Prize; and
-that he or she releases The Q, Corus, the Affiliates, the Sponsor, the Prize Suppliers and all of their directors, officers, employees, agents as well as their respective advertising and promotional agencies (collectively, the “Releasees”) from any and all liability arising in connection with participation in the Contest and acceptance of the Prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting the prize, whether suffered by the Prize winner or his or her guest, or by his or her heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees.
10. PRIZES TO BE ACCEPTED AS AWARDED
The decision of the Contest judges is final. Prizes must be accepted as awarded. No portion of any Prize is transferable. Prizes are not redeemable for cash and no substitute for any portion of a Prize is offered. Should a Prize winner be unable to claim a prize as awarded, his or her entry will be forfeited.
11. SUBSTITUTION OR CHANGE TO THE CONTEST
The Q, Corus, the Sponsor, The Prize Suppliers and their respective advertising and promotional agencies reserve the right to substitute the Prize or any component thereof, for those of approximately the same value and reserve the right to change the Contest rules or terminate or withdraw the Contest at any time, without prior notice.
12. LIMITATION ON NUMBER OF ENTRIES PERMITTED
There is no limit on the number of entries.
13. CHANCES OF WINNING
Chances of winning depend on the number of people who enter the Contest during the Contest Period.
14. OWNERSHIP OF ENTRIES
All entries shall become the property of The Q, Corus, the Sponsor, The Prize Suppliers and their advertising and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed or otherwise indecipherable entries due to any failure or technical malfunction of the telephone network, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, failure of any email or submission or due to any other reason regardless of cause. None of The Q, Corus, the Affiliates or the Sponsor, Prize Suppliers shall be held responsible for any errors made in connection with the administration of the Contest including, but not limited to, any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of his or her participation in the Contest or from downloading any material from the Contest web site.
15. CONSENT TO USE OF PERSONALITY
By entering the Contest, each entrant, including the Prize winner, consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality for any publicity and programming purposes, commercial or otherwise, in all media used by The Q, Corus, the Sponsor, The Prize Suppliers, promoters and their advertising and promotional agencies, without any payment or compensation. The Prize winners further agree that his or her audio reaction may be used for on-air promotional purposes. The entrants understand and acknowledge that The Q may contact him or her on-air without prior knowledge as a result of his or her participation in the Contest.
16. CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION
By entering the Contest and voluntarily providing personal information including, but not limited to, name, address, city, email address, home and office telephone numbers (the “Registrant Information”), each Contest entrant grants permission to The Q, Corus and the Sponsor, The Prize Suppliers to the collection and use of the Registrant Information for the exclusive purpose of administering the Contest and selecting the Prize winner. Unless entrants request otherwise, no correspondence will take place between The Q, Corus, the Sponsors and the entrants except in connection with the Contest and, in the case of the Prize winner, as a result of entering the Contest and winning the Prize.
17. WHERE CONTEST RULES AND REGULATIONS AVAILABLE

18. COMPLIANCE WITH CONTEST RULES
All contestants agree to abide by the Contest Rules and Regulations, which are subject to change at the sole discretion of The Q, Corus and the Sponsors.
19. COMPLIANCE WITH LAWS
This Contest is void where prohibited by law, and is subject to all federal, provincial, territorial and municipal laws and regulations of Canada and of the province of Quebec, respectively.
20. R.A.C.J.
Any litigation respect the conduct and awarding of a prize in this publicity contest may be submitted to “La Regie des alcools, des courses et des jeux” for a ruling. Any litigation respecting the awarding of a prize may be submitted to La Regie only for the purpose of helping the parties reach a settlement. All taxes on the prizes have been paid in accordance with the rules laid down by La Regie des alcools, des courses et des jeux du Quebec.
